On Monday the Supreme Court passed a verdict declaring that daughters had as much right to take over a job in their deceased father’s place the same way a son does.
According to Geo, the case was filed by Zahida Parveen, who was dismissed from her position after her father’s death. The petition was heard by Justice Syed Mansoor Ali Shah and Justice Athar Minallah.
The Khyber Pakhtunkhwa Advocate General said the woman was removed from her position after she got married, and therefore become ineligible for the position. To this, Justice Mansoor responded that no where in the law is it written that a woman cannot work after she gets married.
After the KP Advocate General responded that Ms Parveen was removed from her post under the KP Civil Service Act, to this Justice Mansoor responded that marriage had no connection to economic independence. He further stressed that if a son was eligible to become the successor of his father’s government post after marriage, then the same thing should be available for daughters as well.
Previously in April 2024, the Supreme Court also ruled that male family members were barred from deciding the rules of a Nikkahnama on behalf of a bride, as it would put a risk on her financial independence and freedom.
The ruling also stressed the importance of teaching women on the terms and conditions of a Nikkahnama so she would have the ability to decide her terms with ease.
